Terms & Conditions
Please read the following terms and conditions carefully. You must not make and accept any booking unless you understand and agree with the following terms and conditions (‘Terms and Conditions’). References to “us”, “we”, “our”, ‘Company’ and/or “Canopy and Sky ” in these booking terms and conditions shall mean Canopy and Sky India Private Limited. References to ‘You’, ‘Client’ and/or ‘Customer’ means the person/s in whose name and/or on whose behalf the booking is made and/or whose name is on the Checklist and invoice. References to ‘supplier’ and/or ‘third party providers’ means supplier or provider of any travel related products and services from visa counsellors, passport officers and other relevant governmental agencies (such as DGCA), airlines, restaurants, theme parks, cruises, foreign exchange dealers, caterers, railways, car rental operators, tour operators, hotels, courier companies, transportation and logistics companies etc. We will rely on the authority of the person making the booking to act on behalf of any other travellers/persons on the booking and that person will bind all such other travellers/ persons to these Terms and Conditions. References to ‘Checklist’ means the checklist to be signed by the Client for each booking and forming a part of the Terms and Conditions.
GENERAL TERMS & CONDITIONS :
- We are not holding any rooms or other services for the mentioned package/offer, so rates are subject to availability at the time of booking.
- The quote shared will be based on current availability and the length of stay as requested. Any change in dates/length of stay will affect the quote.
- Tourist/local/city taxes (if any) and gratuities needs to be paid at the hotel/destination directly by the client.
- All services, Hotels , Sightseeing, train tickets or any other services advised should be checked by you at your end. Once the go ahead received it is considered that you have verified the same and agree/accept the same.
- All tours are on SIC & all SIC Tours unless specified otherwise and start from central point located in the city centre. Also for drop off some tour may or may not provide drop off (if they will provide then drop off location will be again some city centre point).
- If any cancellation or changes received after go ahead it will attract a supplement cost.
- All train tickets are subject to price at the time of issuance. Price may fluctuate for train tickets, exact price confirmed upon issuance.
- Please note that we consider the flight arrival time as pick-up time (if applicable). The flight will be monitored for delays and the driver would wait for the passengers for up to 60mins from the flight arrival time, at no extra cost (in case the service is booked).
- The quote does not include anything specifically mentioned in the quotation.
BOOKING PROCESS / TERMS OF PAYMENT
- For processing the reservations, we need – Full name as per passport (in the form of First Name / Last Name), Passport number, Nationality, Expiry date, Flight Details.
- Non Refundable Deposit of USD 250 per person is required to secure space if booked 60+ days.
- Non Refundable Deposit of USD 1000 per person is required to secure space on guaranteed basis if booked within 60 days to travel date.
- Unless company receives the non-refundable deposit or full payment, the company shall not be liable to process the booking / issue any supporting documents.
- The above conditions might change from booking to booking, destination to destination.
- Company reserves the right to amend charges accordingly in case of currency fluctuations, fuel supplement, travel arrangements, hike in any government taxes before the date of departure.
All such increases in price must be paid for in full before your departure. All payments must be received at least 30 days prior to departure.
PAYMENT POLICY:
- All payments to be made in favour of “Canopy & Sky Private Limited” As per the details in the invoice.
- Any and all intermediary bank charges will be borne by the client for all payments including booking amounts and final payments.
- The Rate of Exchange will be the rate quoted as per www.xe.com on the date of the payment.
- In case of international currency payments for hotels/service which are made in INR there will be a remittance charge of 1 Rupee per the international currency amount.
- Service charges, taxes, remittance charges, GST if any are non-refundable.
- No refunds will be made because of airline delays, unused services, or other acts beyond our control.
- Upon completion of the signed booking form a deposit of 50% of the tour cost per person, be paid to the company.
- In case specified otherwise final payment must be received no later than 60 days prior to the date of departure. Final payment must be in the same currency as the deposit and booking.
- All prices are subject to GST, which will be charged upon confirmation of booking.
METHOD OF PAYMENT – CREDIT CARD TRANSACTIONS, ELECTRONIC TRANSFER AND PAYMENT BY CHEQUE, CASH
Prices are valid for payment by Credit card, cash, cheque or bank transfer. Cheques are accepted but take up to four (4) business days to clear, you agree that you will not seek to charge back your payment to Canopy and Sky. Please note that electronic payments may take up to two (2) business days to process. If you are paying by this method you will need to pay at least two (2)business days prior to the actual due date. Please provide us with the bank confirmation number of the electronic payment made for faster reconciliation at our end. You must notify your consultant of your payment once it has been made. Where you pay by cheque, you agree not to stop payment of the cheque even when you cancel a booking. You agree that we may apply the proceeds of the cheque to satisfy any liability you have to us, including any liability in respect of cancellation fees, before refunding the balance to you. Travel documents will not be issued until full payment with cleared funds is received.
As per the government of India regulations, customers will have to provide photocopies of their Income Tax PAN (Permanent Account Number) card to Canopy and Sky, for all bookings above INR 25000 in value.
LIABILITY
We always do our best to make sure your holiday arrangements are satisfactory. However, we cannot accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of these service providers, over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of that particular purchased travel arrangements in respect of which claims arise. The company does not own or control hotels, coach or other facilities mentioned in the tour. As an operator of the package tour therefore, we cannot be held liable. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. In particular, but without limitation to these conditions, we accept no responsibility for any loss, damage or injury you suffer as a result of terrorism, war (including civil-war), coup, riot, civil disturbance or any type of criminal act. It is your responsibility to inform yourself about the safety and security situation in the places you are travelling to.
Under no circumstances shall the Company be liable to the Client and/or travellers/persons travelling with the Client for any personal injuries, sickness, and loss of baggage or denial of visas. In any case, the Company shall not be liable towards any consequential loss, damage or extra costs suffered by the Client for any reasons whatsoever.
CANCELLATION OF BOOKINGS :
If you wish to cancel your booking with us, you must inform us in writing and get an acknowledgement from us. The following cancellation charges shall apply irrespective of the reason for cancellation. These are estimated damages we will incur on account of you cancelling tour booked by you. You agree not to dispute such deductions or nor to demand proof of actual damages.
WHEN A CANCELLATION IS MADE CANCELLATION CHARGES PER PERSON
- 60 to 30 days to departure: 40% of tour cost
- 29 to 20 days to departure: 50% of tour cost
- 9 to 15 days to departure: 75% of tour cost 14 days to departure : Less than 72 hours or No Show – No Refund.
- 100% of tour cost (If you fail to make payment as per schedule and if we do not receive full payment before the departure date, the booking stands cancelled)
- The above might be different from booking to booking & Destination to Destination
For any train or flights tickets involved, the refund will be applicable as per the advised cancellation policy at the time of booking.
Note: We are travel consultants, our services & know how, cost time and money !
In case the services, once booked and confirmed – and paid for – either deposit or full payment thereof, are cancelled at any point in time, the company reserves the right to charge a consultation charge commensurate and appropriate to the time taken in replying and advising to the clients questions / queries and the time take by our back office in dealing with our principal suppliers.
